Gotcha! Is It Legal Or Illegal To Remove Political Campaign Signs In New York State?
If you have a social media account, a television or a radio it would be pretty difficult to not know that Tuesday November 5, 2024 is Election Day in the United States! One of the most visible reminders are the political signs dotting the New York landscape.
Planting a political campaign sign, at a busy intersection in town for example, is one way to show support for your candidate of choice. Your sign could also invite the reactions, pro and con, of your neighbors and passersby. Is it legal to remove a campaign sign in New York State?
In accordance with New York State Division of Election Law Enforcement, political signs are protected under the free speech provisions of the United States and New York State Constitutions. However, in your hometown you could be breaking the law by not only posting these signs but by leaving them up too long.
Each local New York State government may have their own regulations on campaign signs. Posting any signs on public property falls under the jurisdiction of the town, county and other local governments BUT removal of campaign signs is ILLEGAL in New York State. Don't do it!
In the town of Colonie, New York, for example, any political signs must be removed within 30 days after the election. In the city of Troy, New York no more than 2 political signs may be displayed on any one property.
New York State Department of Transportation have their set of rules as well:
- Signs should not get in the way of workers maintaining the roadside
- Signs should not interfere with safe traffic movement
- Signs should not be placed in a median or traffic island-type area
